NOTICE OF THE PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE TOWN OF PENETANGUISHENE TAKE NOTICE THAT the Council of the Corporation of the Town of Penetanguishene passed By-law 2010-12 on the 27th day of January, 2010 under Section 34 of the Planning Act, R.S.O. 1990. AND TAKE NOTICE THAT any person or agency may appeal to the Ontario Municipal Board in respect of the by-law by filing with the Clerk of the Town of Penetanguishene not later than the 23rd day of February, 2010 a notice of appeal setting out the objection to the by-law and the reasons in support of the objection, accompanied by the fee required by the Ontario Municipal Board as prescribed under the Ontario Municipal Board Act. By-law 2010-12 relates to vacant lands composed of Part of Lot 114, Concession 1, formerly Township of Tiny, now Town of Penetanguishene, being part of Parts 2 & 3, Plan 51R-22174, comprising Phase 2 of a residential subdivision locally known as Bellisle Heights. No key map has been provided due to the size of the parcel. (NOTE: The land to which By-law 2010-12 applies is the subject of an application under the Planning Act for a Plan of Subdivision – Town File: PEN-SUB-2004-01). The purpose of By-law 2010-12 is to rezone the subject lands from RURAL (RU) to RESIDENTIAL SECOND DENSITY – HOLDING (R2-H). The effect of the by-law is to permit the second phase of the subdivision to be developed into a total of fifty-four (54) single detached homes. Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
