Notice of Passing Zoning By-law Amendment Regarding 948 Fuller Avenue

NOTICE OF THE PASSING OF A ZONING BY-LAW AMENDMENT

BY THE CORPORATION OF THE TOWN OF PENETANGUISHENE 

TAKE NOTICE THAT the Council of the Corporation of the Town of Penetanguishene passed By-law 2018-03 on January 24, 2018 under Section 34 of the Planning Act, R.S.O. 1990.

By-law 2018-03 pertains to lands composed of Part of Lot 32B, Registered Plan 70 and more particularly described as Part 1 on Reference Plan 51R-41349 in the Town of Penetanguishene, municipally known as 948 Fuller Avenue (see location map).

THE PURPOSE AND EFFECT of the proposed Zoning By-law Amendment is to rezone the property from the Residential First Density (R1) zone to Institutional (G) zone. The effect of the application would be to permit the property to be developed for Institutional uses (Hospice).   

AND TAKE FURTHER NOTICE that any person or agency may appeal the By-law by filing with the Clerk of the Town of Penetanguishene, not later than February 14, 2018, a notice of appeal on the requisite Ontario Municipal Board (OMB) Appeal Form setting out the objection to the By-law and the reasons in support of the objection, accompanied by the fee prescribed under the Ontario Municipal Board Act in the amount of $300.00 which must be in the form of a cheque payable to the Minister of Finance. Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party. 

CORRESPONDENCE RECEIVED from the public and external agencies on the proposed amendment were summarized and included in Staff Report PD-17-82 for the Public Meeting on December 13, 2017. Comments received at or after the public meeting were summarized and considered in the preparation of the final Zoning By-law and were included in Staff Report PD-17-86 for the Committee of the Whole meeting on January 10, 2018.
