NOTICE OF COMPLETE APPLICATION &

NOTICE OF PUBLIC MEETING CONCERNING A

PROPOSED ZONING BY-LAW AMENDMENT 

TAKE NOTICE THAT the Town of Penetanguishene deemed the following application to amend the Town’s Zoning By-law 2000-02, as amended, a “complete” application under Section 34 of the Planning Act, R.S.O. 1990 on the 14th day of March 2018.

TAKE NOTICE THAT pursuant to Section 34 of the Planning Act, R.S.O. 1990, the Council of the Corporation of the Town of Penetanguishene will hold a public meeting on Wednesday, April 11, 2018 at 7:00 p.m. in the Council Chambers, Townhall, 10 Robert Street West, Penetanguishene to consider a proposed Zoning By-law Amendment.

The proposed Zoning By-law Amendment (Z.A. 3/2018) relates to lands legally described Part of Lots 73 and 74 Plan 1521 and more particularly described as Part 5 on Reference Plan 51R-3896, Parts 1 to 3 inclusive Reference Plan 51R-19385 and Part 1 on Reference Plan 51R-32001 and municipally known as 173 and 177 Robert Street East.   (see Location Map).

THE PURPOSE AND EFFECT of the rezoning is to site specifically amend the Industrial Services M1 zone to an Industrial Services Exception XX M1-xx zone to increase the maximum permitted Lot Coverage from 50% to 70% and to provide a new definition as it relates to this exception for Lot Coverage from Gross Floor Area to Ground Floor Area to determine the maximum amount of Lot Coverage permitted. The effect of the application would be to permit the redevelopment of the property as a Marijuana Production Facility with an increased building footprint than currently permitted under the Zoning By-law

ANY PERSON MAY attend the public meeting and make oral or written representation either in support of, or in opposition to, the proposed Zoning By-law Amendment.  If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Penetanguishene before a zoning by-law amendment is passed, the person or public body is not entitled to appeal the decision of the Council of the Town of Penetanguishene to the Ontario Municipal Board.  Also, if a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Penetanguishene before a by-law amendment is passed the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

ADDITIONAL INFORMATION regarding the proposed amendment is available to the public for inspection at the Penetanguishene Municipal Office between 8:30 a.m. and 4:30 p.m. Monday to Friday.
